DART Command Central (DARTCC) Terms of Use

The services that DART COMMAND CENTRAL – DART ("DARTCC") provides to you are subject to the following Terms of Use ("TOU").

By accessing or using our website or Services, you agree to comply with and be bound by these TOU.

DARTCC reserves the right to update or modify these TOU at any time without notice. The most current version can always be reviewed by visiting https://dartcc.org/about/terms.

Your continued use of the Services after any changes are posted constitutes your acceptance of the updated TOU.

2. Definitions

  • "Services" means the website, software, resources, communications forums, download areas, developer tools, product information, and any related content provided by DARTCC.
  • "Website" refers to https://dartcc.org and https://easapp.org and any associated subdomains or web properties.
  • "Software" refers to downloadable tools, applications, and code provided by DARTCC.

3. Description of Services

DARTCC provides access to a variety of resources intended to support the animal welfare community, particularly during natural disasters providing shelter and care for these animals.

The Services include, but are not limited to, tools for disaster response, communication forums, downloadable resources, and product information.

4. Limitation of Usage

Unless otherwise specified, Services are provided for the purpose of supporting animal welfare emergency response efforts.

You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained through the Services without DARTCC’s express written consent.

5. Privacy and Protection of Personal Information

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

6. Content Ownership

All content included in or made available through the Services—such as text, graphics, logos, images, sounds, software, and documents—is the exclusive property of DARTCC or its content suppliers.

This content is protected by trade dress, copyright, trademark, patent, and other intellectual property laws in the United States and internationally.

All rights not expressly granted are reserved and retained by DARTCC.

7. Software

Any Software made available for download through the Services is the copyrighted work of DARTCC and may be subject to an End User License Agreement ("License Agreement").

Users must agree to the terms of any applicable License Agreement before installation or use.

Unauthorized reproduction or redistribution of the Software is strictly prohibited and may result in severe civil and criminal penalties.

Software downloaded for or on behalf of the U.S. Government is provided with Restricted Rights under applicable federal regulations (DFARS 252.227-7013 and 48 CFR 52.227-19).

8. Use of Documents

Permission to use Documents (such as guidelines, press releases, datasheets, and FAQs) from the Services is granted under the following conditions:

  • The copyright notice and permission notice must appear in all copies.
  • Use is for informational, non-commercial, or personal purposes only.
  • No modifications may be made to the Documents.
  • Documents may not be posted to network computers or broadcast in any media without express permission.
  • Accredited educational institutions may download and reproduce the Documents for classroom use; any other distribution requires express written permission.

Documents do not include the design or layout of the Website or other DARTCC sites, which are protected separately by intellectual property laws.

These Terms of Use are governed by and construed in accordance with the laws of the State of Vermont, without regard to its conflict of law principles.

Any disputes arising under these TOU shall be resolved exclusively by the courts located in Vermont.
